Opened Consultation on FTC Guidelines on Abuse of Market Dominance by Online Platform Operators

On 6 January 2022, the Fair Trade Commission (FTC) opened a public consultation on the proposed Guidelines on abuse of market dominance by online platform operators for public consultation until 26 January 2022. The Guidelines outline the FTC approach for determining the entities that abuse their power and engage in unfair practices such as self-preferencing. The Guidelines list the practices platforms employ that allow them to have substantially more power than their multi-home platform counterparts. Furthermore, the FTC also elaborates on factors it will consider when investigating platforms, including tipping effects, multi-side characteristics, self-preferencing, most-favoured-nation clauses and bundling.
