On 17 November 2022, US Federal Trade Commission (FTC) opened a public consultation on the “Business Opportunity Rule until 30 January 2023. The consultation process was originally scheduled to conclude on 17 January 2023, and the FTC extended the deadline to 30 January 2023 from 17 January 2023. The consultation seeks, among others, comments on whether the Business Opportunity Rule should include electronic commerce within its scope. The Rule is designed to ensure that consumers receive information to help them evaluate business opportunities. Under the Rule, sellers are required to disclose certain information, including their identifying information and cancellation or refund policy, among others. The Rule also prohibits misrepresentations and omissions.
