Consultation closed on Expansion of Business Opportunity Rule including Electronic Commerce

On 31 January 2023, the US Federal Trade Commission (FTC) closed the public consultation on the amendment of the “Business Opportunity Rule”. The consultation sought, among others, comments on whether the Business Opportunity Rule should include electronic commerce within its scope. The Rule is designed to ensure that consumers receive information to help them evaluate business opportunities. Under the Rule, sellers are required to disclose certain information, including their identifying information and cancellation or refund policy, among others. The Rule also prohibits misrepresentations and omissions.
