Telecommunications Legislation Amendment (International Production Orders) Bill 2020 enters into force

On 23 July 2021, the Telecommunications Legislation Amendment (International Production Orders) Act 2021 enters into force after receiving Royal Assent. The Act establishes a new system allowing Australian Agencies to issue “international production orders” to communications providers in order to obtain data stored overseas. The agencies conducting criminal investigations can issue orders to companies providing services to at least one Australian resident. In case of noncompliance, communications providers could face a civil penalty of up to AUD 10 million.
