Issued FCC draft Rule updating Data Breach Reporting Requirements

On 28 December 2022, the US Federal Communications Commission (FCC) published the draft Rule on Data Breach Reporting Requirements. The updated requirement would remove the current mandatory waiting period of seven business days before notifying customers of a breach and clarify that inadvertent breaches should also be notified. In addition, telecommunications carriers would be required to notify the FCC, the Federal Bureau of Investigation, and the US Secret Service of all data breaches.
