Opened consultation on FCC draft Rule updating Data Breach Reporting Requirements

On 23 January 2023, the public consultation opens on the US Federal Communications Commission (FCC) draft Rule updating Data Breach Reporting Requirements until 22 February 2023. The updated requirement would remove the current mandatory waiting period of seven business days before notifying customers of a breach and clarify that inadvertent breaches should also be notified. In addition, telecommunications carriers would be required to notify the FCC, the Federal Bureau of Investigation, and the US Secret Service of all data breaches. The FCC seeks stakeholders' comments on the proposed changes, as well as on the Commission's telecommunications relay services (TRS) data breach reporting rule and on the potential requirement to include specific categories of information in consumer breach notices.
