On 25 November 2022, the European Commission introduced a draft Regulation on the transparency and targeting of political advertising. The Regulation would apply to political advertisements, including ads concerning issues that might influence a political consultation's outcome. The Regulation introduces transparency labels, strict conditions for targeting and amplification, as well as fines for breaches of the terms outlined in the Regulation. Under the Regulation, Member States will be required to designate one authority competent to enforce the Regulation. Investigations into the compliance with the Regulations provisions will be conducted in the Member State where the provider is established. In cases where the provider is established in more than one Member State, it will be under the jurisdiction of the State where it has its main establishment.
