Entry into force of Regulation implementing Article 46 of the Digital Markets Act

On 2 May 2023, the Regulation implementing Article 46 of the Digital Markets Act (DMA) on detailed arrangements for the conduct of certain proceedings by the Commission, is implemented. The Regulation outlines the procedural framework of DMA enforcement. In particular, the Regulation sets out the rules on notifications, requests and other information submissions requirements under the DMA. Further, it sets out the rules on the opening of proceedings, the right to be heard and the addressee's right to access the file on the Commission's preliminary findings.
