Replacement of E.O. 13971 with prohibition criteria

Through the Executive Order "Executive Order on Protecting Americans' Sensitive Data from Foreign Adversaries", the Biden administration replaces the company-specific prohibition of transactions made in E.O. 13971 with a set of criteria for prohibited transactions. These criteria, first established in E.O. 13873 of May 15, 2019, prohibit any transaction with a company under control of a "foreign adversary" that could pose an unacceptable risk to national security, an undue risk of sabotage of US ITC goods or service production, or undue risk of catastrophic effects on US critical infrastructure including the digital economy.
