Closed consultation on Amazon's commitments addressing EU Commission statement of objections regarding non-public data use

On 9 September 2022, the consultation on Amazon's commitments regarding the use of non-public data closes. The Commission in its preliminary view alleged that Amazon is using non-public data collected from competing sellers to favour its products and on 14 July 2022 opened a consultation on the commitments from Amazon addressing its allegations. In order to address the issues raised by the Commission, Amazon stated that it will not use non-public data from sellers using its marketplace for its retail services. The non-public information includes aggregate and individual data on sales, delivery, user behavioural data and sellers’ performance. Furthermore, the company commits to applying this principle to its automated tools and employees working on economic development activities.
