French Council of State upholds fine on Amazon issued by CNIL

On 27 June 2022, the French Council of State issued a ruling upholding the fine imposed on Amazon by the National Commission for Informatics and Freedoms (CNIL), rejecting an appeal by Amazon. The court confirmed that CNIL has the competence to impose sanctions and the previous fine was in line with the law. On 7 December 2020 CNIL fined Amazon for two violations of Article 82 of the French Data Protection Act. Specifically, Amazon deposited cookies on "Amazon.fr" without the users' consent and without having sufficiently informed them about the cookies. CNIL had fined Amazon EUR 35 million, which according to the Council of State, was not disproportionate to the seriousness of the infringements.
