FTC opens consultation on Revision of Dot Com Disclosure Guidelines regarding online advertising

On 3 June 2022, the Federal Trade Commission (FTC) opened a consultation on the possible revision of the Dot Com Disclosure Guidelines on online advertising practices. The main concern of the FTC is that the existing guidelines, issued in March 2013, are abused by companies to justify deceptive practices and avoid liability under the FTC Act. Therefore, the FTC seeks comments on the potential revision of the guidelines specifically concerning the issues of social media advertising, embedded game advertisements, and "dark patterns" (deceptive user interfaces).
