On 10 March 2026, the Kenya Copyright Board opened a consultation on the draft Copyright and Related Rights Bill, 2026 until 31 March 2026. The draft bill would apply to online intermediaries, including internet service providers, social media platforms, online marketplaces, search engines, and video sharing platforms. It would require online intermediaries to remove or disable access to infringing content within 48 hours of receiving a valid takedown notice and to notify the person responsible for the content within 24 hours. A counter-notice procedure would allow affected users to contest removal. The Kenya Copyright Authority would be required to determine such disputes within 7 days. The draft bill would also provide for site-blocking orders, including preemptive injunctions for live events, which the Copyright Disputes Tribunal would be required to decide within 72 hours of application.
