Nigeria: Internet Code of Practice including measures regarding enforcement enters into force with grace period

On 15 May 2026, the Internet Code of Practice, including measures regarding enforcement, enters into force with grace period. It provides that the Commission is responsible for monitoring and enforcing compliance with the Code and may require regulated entities to provide information on their obligations, including network capacity management and traffic measures. It also provides that where non-compliance is identified, the Commission will notify the entity, specify corrective actions, and require a compliance report within 14 days, in line with the Nigerian Communications (Enforcement Processes) Regulations 2019. The Code further provides that the NCC Consumer Web Portal will receive and investigate complaints regarding non-compliance. Further, internet access service providers and other impacted entities must submit biannual compliance reports using prescribed templates and respond to additional reporting requests issued by the Commission. The Commission will also engage international agencies, regulators, and cross-national bodies through peer review and coordinated governance efforts, and collaborate with relevant national organisations to implement governance rules and support enforcement. It may issue additional governance standards and requirements, developed in consultation with licensees and impacted entities, to give effect to the Code.
