On 20 February 2026, the District Court for the District of Montana dismissed the challenges brought by TikTok against the Montana Attorney General concerning the constitutionality of the Act Banning TikTok in Montana (SB 419). The parties filed a joint stipulation of dismissal after agreeing that the legislation had become void under its own internal provisions. SB 419 was designed to prohibit the operation of the social media platform within the state. Section 4 of the Act specified that the ban would be rendered void if TikTok were acquired by or sold to a company not incorporated in a country designated as a foreign adversary according to federal regulations. The litigants acknowledged that this condition was met following the transaction detailed in Executive Order 14352, titled Saving TikTok While Protecting National Security, which was published on 25 September 2025. Under the terms of the dismissal, each party agreed to bear its own legal costs. The resolution effectively terminates the proceedings as the underlying prohibition is no longer enforceable due to the change in ownership status of the platform intermediary. This outcome follows an earlier period of litigation where the plaintiffs argued the ban violated constitutional protections, while the state defended the measure on security grounds.
