Issued ruling in public lawsuit over Act banning TikTok in Montana (TikTok v Montana)

On 30 November 2023, the United States District Court for the District of Montana issued a preliminary ruling granting an injunction which prevents the entry into force of "An Act Banning TikTok in Montana" (SB 419), as requested by TikTok. Bill 419, which was scheduled to come into effect on 1 January 2024, foresees a ban on TikTok from the state. The Court determined the Bill as exceeding Montana's jurisdiction over national security and foreign policy matters, potentially contradicting the First Amendment. In addition, the reasoning provided for the ban was deemed insufficient. The preliminary ruling applies until the final trial, which is expected to take place in 2024.
