On 12 February 2026, the Office of Communications (Ofcom) issued the provider of Im.ge with a provisional notice of contravention under Section 130 of the Online Safety Act 2023. Ofcom stated that it has reasonable grounds to believe the provider failed to comply with its duty under Section 9(2) to carry out a suitable and sufficient illegal content risk assessment. Ofcom may determine that Sections 10(2)(b) and 10(2)(c) apply as if Im.ge had conducted an illegal content risk assessment and identified a high risk of image-based child sexual abuse material (CSAM). Ofcom confirmed that it will consider any representations submitted in response to the provisional notice before making a final decision. In addition, Ofcom published a non-confidential version of a Confirmation Decision originally issued on 17 December 2025. That decision concerned the provider’s failure to comply with two statutory information requests. It imposed a fixed penalty of GBP 20’000 for both breaches and warned that continued non-compliance could lead to a daily penalty of GBP 100 for up to 60 days, or until the requested information is provided.
