Federal Court set aside order to wind up TikTok’s operations in Canada and remitted matter for a new review

On 21 January 2026, Canada’s Federal Court set aside the order to wind up TikTok’s operations in Canada following a national security review under the Investment Canada Act and remitted the matter to the Minister of Industry for a new review under subsection 25.3(6)(case T-3463-24). The Court decision allows TikTok’s Canadian operations to continue, and the new review must begin from the point at which TikTok was formally notified under subsection 25.3(2), and the notice is to be sent immediately. The decision followed a judicial review application filed by TikTok Technology Canada on 5 December 2024 under Section 18.1 of the Federal Courts Act.
