President adopted Order No. 2026-2 relating to the remote marketing of financial services to consumers including fair marketing and advertising practices

On 5 January 2026, the President adopted Order No. 2026-2 relating to the remote marketing of financial services to consumers, implementing EU Directive 2023/2673 on financial services contracts concluded at a distance with the purpose of strengthening fair marketing and advertising practices in distance communications. Articles 6, 8, 9, 15, 17, 18, 20 and 21 amend the relevant provisions of various codes, Consumer Code, Insurance Code, Mutuality Code, Social Security Code, and Monetary and Financial Code, to require professionals to disclose clearly and unambiguously the commercial purpose of any contact, their identity, and any intermediary relationship, including at the start of telephone communications. The Order enters into effect on 19 June 2026.
