On 22 July 2025, the Secretary of State made the Online Safety Super-Complaints (Eligibility and Procedural Matters) Regulations 2025 under sections 169(3), 169(4), 170(1), 170(2), and 224(1) of the Online Safety Act 2023. The Regulations establish eligibility criteria for entities entitled to submit super-complaints to the Office of Communications (Ofcom) under section 169(1) of the Online Safety Act 2023 and set out procedural requirements governing such complaints. They specify supporting evidence for eligibility, information requirements for super-complaints, grounds and procedures for eligibility determinations by Ofcom, mandatory and discretionary rejection grounds, withdrawal rules, acknowledgement of receipt, statutory time limits for determinations and responses, publication obligations, and restrictions on submitting repeat complaints. The Regulations extend to England and Wales, Scotland, and Northern Ireland. The Secretary of State consulted Ofcom and other appropriate persons. A draft instrument was laid before Parliament and approved by resolution of each House.
