Competition and Markets Authority released updated guidance on unfair commercial practices

On 3 December 2025, the Competition and Markets Authority updated the guidance on unfair commercial practices, first published on 4 April 2025, reiterating all requirements under the Digital Markets, Competition and Consumers Act 2024. The update confirms the scope of commercial practices, the list of 32 always-banned practices, and the categories of unfair practices linked to misleading actions, misleading omissions, aggressive practices, and failures of professional diligence. It restates that enforcement authorities may issue fines of up to 10% of worldwide turnover and require compensation, and again notes that the Digital Markets, Competition and Consumers Act 2024 came into force on 6 April 2025. It repeats the obligations for invitations to purchase and the transparency duties relating to reviews, trust marks, pricing, after-sales care, and codes of conduct.
