Description

United States and Argentina announced Agreement on Reciprocal Trade and Investment including measures recognising US as an adequate jurisdiction for cross-border data transfers

On 13 November 2025, the United States and Argentina announced their Reciprocal Trade and Investment Agreement, which includes cross-border data transfer regulations. Under the agreement, Argentina committed to recognising the United States as an adequate jurisdiction for cross-border data transfers, including personal data. Argentina has further committed to refraining from imposing trade limitations against US digital services or digital products. Furthermore, Argentina intends to recognise electronic signatures under the US legal system as valid under Argentine law. In addition to data transfer provisions, Argentina has committed to addressing certain intellectual property structural concerns cited in the US 2025 Special 301 Report. Other aspects include efforts to eliminate non-tariff barriers, improve labour rights, and increase cooperation in commercial opportunities related to critical minerals. The full text of the Agreement is still being finalised.
