Canada: Competition Bureau opened consultation on anti-competitive conduct and agreements guidelines

On 31 October 2025, the Competition Bureau opened a public consultation on its draft guidelines on anti-competitive conduct and agreements, until 29 January 2026. The guidelines set out expectations for dominant firms to avoid conduct that substantially lessens competition and prohibit agreements that restrict market entry or limit competition. The draft also clarifies that suppliers must not refuse supply to competitors on usual trade terms and that price maintenance practices are not permitted. The Bureau may seek tribunal orders to stop such conduct, require asset divestitures, or impose administrative monetary penalties of up to CAD 35 million or three times the benefit gained from the violation.
