On 29 September 2025, the Aligning Incentives for Leadership, Excellence, and Advancement in Development Act (AI LEAD Act/S.2937) was introduced in the Senate, requiring developers of artificial intelligence systems to provide adequate instructions and warnings regarding foreseeable uses and misuses of their systems and recognising liability for breach of express warranty. Liability attaches where instructions or warnings are inadequate in relation to the risks posed, where express warranties regarding system performance or safety are not honoured, and where marketing or guidance documents contribute to a defective condition that proximately causes harm.
