On 15 September 2025, the Office of the United States Trade Representative opened a consultation on significant foreign trade barriers for the 2026 National Trade Estimate Report, until 30 October 2025. The consultation applies to foreign measures affecting services, intellectual property, and competition practices that restrict U.S. exports, digital trade, or investment. It seeks input on discriminatory barriers to cross-border data flows, restrictions on internet-enabled services, and unfair licensing or local-presence rules. It also covers weak patent, copyright, and trademark protection, and anticompetitive conduct by state-owned or private firms.
