On 26 August 2025, the Act concerning measures to increase transparency for Artificial Intelligence (AI) systems (SB 25B-004), including user/subject rights, was adopted by the Colorado General Assembly. The amendment delays enforcement of the law from the original date of 1 February 2026 to 30 June 2026. The Act requires developers to disclose intended uses, risks, mitigation measures, and system details to deployers. Deployers must notify individuals when algorithmic systems inform decisions, explain data sources, and provide procedures to access and correct personal data. The Act also grants individuals the right to know and correct personal data used in automated decisions. The Act mandates disclosure when people interact with generative AI systems. It establishes joint and several liability for unlawful use unless the misuse was unforeseeable and contractually barred. Violations are deemed unfair or deceptive trade practices under the Colorado Consumer Protection Act.
