On 21 August 2025, an Act concerning measures to increase transparency for Artificial Intelligence (AI) systems (SB 25B-004), including user/subject rights, was introduced to the Colorado Senate. The Act repeals and re-enacts with amendments the Colorado AI Act (SB 24-205). The Act requires developers to disclose intended uses, risks, mitigation measures, and system details to deployers. Deployers must notify individuals when algorithmic systems inform decisions, explain data sources, and provide procedures to access and correct personal data. The Act also grants individuals the right to know and correct personal data used in automated decisions. The Act mandates disclosure when people interact with generative AI systems. It establishes joint and several liability for unlawful use unless the misuse was unforeseeable and contractually barred. Violations are deemed unfair or deceptive trade practices under the Colorado Consumer Protection Act. The Attorney General is authorised to adopt rules, and funds are appropriated for state implementation.
