Presidential Decree No. 34724 amending Enforcement Decree of the Communications Secrets Protection Act enters into force

On 24 July 2024, Presidential Decree No. 34724, which had been adopted on 23 July 2024, entered into force, partially amending the Enforcement Decree of the Communications Secrets Protection Act to strengthen regulatory procedures concerning government access to communication data. The amendment established Article 41-2, setting a standard enforcement fine of KRW 5 million for non-compliance with lawful requests for communication fact confirmation data and introducing procedural safeguards such as prior written notice and a 10-day period to present oral or written opinions. Concurrently, Article 41-3 was revised to permit the Minister of Science and ICT to process resident registration numbers in connection with duties related to enforcement fines and the disqualification of detection operators under Articles 15-4 and 10-4 of the Act.
