Presidential Decree No. 34724 amending Enforcement Decree of the Communications Secrets Protection Act was adopted

On 23 July 2024, the President of the Republic of Korea adopted Presidential Decree No. 34724, partially amending the Enforcement Decree of the Communications Secrets Protection Act, with the amendment entering into force on 24 July 2024. The amendment established Article 41-2, which introduced procedures for imposing and collecting enforcement fines related to government requests for communication data, pursuant to Article 15-4 of the Act. The provision sets the standard enforcement fine at KRW 5 million for non-compliance and obliges the Minister of Science and ICT to provide advance written notice and an opportunity to submit statements before enforcement. In connection with this mechanism, Article 41-3 was also amended to authorise the processing of resident registration numbers when necessary for performing duties related to enforcement fine imposition and handling disqualification of detection operators, thereby supporting accountability and traceability in the execution of communication data requests.
