On 20 January 2022, the European Parliament agreed on a common position on the draft Digital Services Act (DSA). The adopted text outlines risk assessment rules and audit requirements for platforms providing their services to more than 45 million local users. The adopted text states that platforms have to refrain from implementing “dark patterns” techniques that influence consumer behaviour. Furthermore, in the adapted text the “very large online platforms” have to provide consumers with a “recommender system” that doesn’t use user profiling.
