Act to prohibit nonconsensual creation or alteration of private images of individuals (HB 161) enters into force

On 1 October 2024, a Bill prohibiting the nonconsensual creation or alteration of private images of individuals (HB 161) enters into force. The Bill amends Section 13A-6-240 of the Code of Alabama 1975 to criminalise the creation, recording, or alteration of private images without consent, where a reasonable expectation of privacy exists, and provides penalties for violations, including escalating charges for repeat offences. It also includes safe harbor provisions stating that internet service providers, search engines, cloud service providers, and technology developers shall not be held liable solely for providing access to content or tools used by others to violate the law.
