On 14 February 2024, a Bill to prohibit the nonconsensual creation or alteration of private images of individuals (HB 161) was introduced to the Alabama House of Representatives. The Bill proposes amendments to Section 13A-6-240 of the Code of Alabama 1975 to establish criminal offences for knowingly creating, recording, or altering a private image without the depicted individual’s consent, where a reasonable expectation of privacy exists. It would also expand the definition of a private image to include manipulated or artificially generated content that appears to depict a real person. The Bill is set to enter into force on 1 October 2024.
