On 26 March 2025, the Oklahoma House of Representatives passed House Bill 1364 (HB 1364), which prohibits the nonconsensual sharing of AI-generated sexual images. The Bill will now be considered by the Senate. It would amend the Oklahoma Law on Obscenity and Child Sexual Abuse Material to cover the dissemination of private sexual images, including those created or altered using artificial intelligence or other technical means. Definitions for “artificial intelligence,” “generative artificial intelligence,” and “artificially generated sexual depiction” would be set out. The Bill would make it an offence to share real sexual images without consent where a reasonable expectation of privacy exists, and to share artificially generated depictions with intent or reckless disregard to cause harm. Exceptions would apply for lawful criminal investigations, the reporting of unlawful conduct, voluntary public exposure, and other lawful purposes. Penalties would range from a misdemeanour to a felony, depending on factors such as intent, material benefit, and frequency. The Act is scheduled to enter into force on 1 November 2025.
