On 3 February 2025, a Bill prohibiting the nonconsensual sharing of AI-generated sexual images (HB 1364) was introduced to the Oklahoma House of Representatives. It would introduce statutory definitions for terms such as “artificial intelligence,” “generative artificial intelligence,” and “artificially generated sexual depiction.” The Bill would make it an offence to intentionally share real or artificially generated sexual images of another person without that person’s effective consent, where the image was obtained or created under circumstances in which a reasonable person would expect privacy. Exemptions would apply in cases involving lawful criminal investigations, reporting of unlawful conduct, voluntary public or commercial exposure, or other lawful purposes. Penalties would range from a misdemeanour punishable by up to one year in jail or a fine of up to USD 1'000 to a felony punishable by up to ten years in prison, with sex offender registration required for repeat violations. Courts would also be authorised to order the removal of the images. The Act is scheduled to take effect on 1 November 2025.
