On 26 January 2022, the Pacific Alliance and Singapore Free Trade Agreement (PASFTA) was signed by Singapore, Chile, Colombia, Mexico and Peru. Under Chapter 13, Article 13.14 of the agreement, each Party is required to permit the cross-border transfer of information by electronic means, including personal data, when necessary for the business activities of a covered person. However, a Party may adopt or maintain measures that restrict such transfers if these measures are necessary to achieve a legitimate public policy objective. Any such measure must not be applied in a manner that is arbitrary or unjustifiably discriminatory, must not serve as a disguised restriction on trade, and must be no more restrictive than necessary to achieve the stated objective. The PASFTA will enter into force upon completion of their respective domestic ratification processes.
