Pacific Alliance and Singapore Free Trade Agreement including cross-border data transfer regulation enters into force for Singapore, Chile, and Peru

On 3 May 2025, the Pacific Alliance and Singapore Free Trade Agreement (PASFTA) entered into force for Singapore, Chile, and Peru. The PASFTA has not yet entered into force for Mexico and Colombia because both countries are still completing their domestic ratification procedures. Under Chapter 13, Article 13.14 of the agreement, each Party is required to permit the cross-border transfer of information by electronic means, including personal data, when necessary for the business activities of a covered person. However, a Party may adopt or maintain measures that restrict such transfers if these measures are necessary to achieve a legitimate public policy objective. Any such measure must not be applied in a manner that is arbitrary or unjustifiably discriminatory, must not serve as a disguised restriction on trade, and must be no more restrictive than necessary to achieve the stated objective.
