ASEAN, Australia and New Zealand FTA Upgrade including consumer protection provisions entered into force

On 21 April 2025, the Upgrade to the ASEAN-Australia-New Zealand Free Trade Agreement (AANZFTA) entered into force. It had previously been adopted on 21 August 2023. The agreement introduces consumer protection commitments under the Electronic Commerce Chapter, requiring parties to adopt measures against fraudulent and misleading online commercial practices. It includes transparency provisions for online transactions and promotes cooperation on activities to strengthen consumer protection. The agreement also includes obligations to adopt or maintain a legal framework for personal data protection, taking into account international standards and guidelines. Additionally, the Upgrade contains commitments to expedite customs clearance of perishable goods within six hours, including during humanitarian emergencies. These provisions apply to Australia, New Zealand, Singapore, Malaysia, Lao PDR, and Brunei Darussalam, with other ASEAN Member States to follow upon completion of domestic implementation procedures.
