Delhi High Court upheld order for Wikimedia Foundation to remove allegedly defamatory content against ANI Media

On 8 April 2025, a division bench of the Delhi High Court upheld a previous ruling requiring Wikipedia to remove content considered defamatory towards ANI Media Pvt. Ltd. The Court, however, suspended two elements of the initial order. The first includes the instruction to remove the protection status of ANI’s Wikipedia page, thereby permitting public editing. The second concerns the general ban on future defamatory edits. Consequently, the page remains protected, and no restriction on future edits is currently in place. The Court instead introduced a more procedural approach, specifically if ANI identifies additional defamatory content, it may notify the Wikimedia Foundation via email, which is then required to take it down within 36 hours in line with India’s Information Technology Rules. If no action is taken, ANI may submit a new application to the Court.
