On 5 January 2022, the Cyberspace Administration of China (CAC) published its Provisions on the Administration of Mobile Internet Application Information Services (Draft), which include user cybersecurity measures. At the same time, the CAC opened a public consultation which will run until 20 January 2022. The Draft Regulations would apply to both application distribution platforms and providers of applications involving information services, such as messaging, e-commerce, audio and video services. App providers would be required to abide by existing network security standards, take appropriate remedial action and notify both users and the relevant authorities in case of an incident. Further, they would need to establish appropriate data security measures, including taking technical measures and implementing a monitoring process. Application distribution platforms would also be required to discontinue their service to apps that are found to contain security risks.
