Argentina fines Facebook for abusive terms in WhatsApp Privacy Policy

On 6 January 2022, the Argentine consumer protection agency (Dirección Nacional de Defensa del Consumidor y Arbitraje en Consumo - DNDC) issued the maximum fine of 5 million pesos against Facebook for its abusive terms in the WhatsApp privacy policy. According to the DNDC, the terms in question do not provide sufficiently clear and certain information and are abusive because they represent an attempt by Facebook to limit its responsibilities towards its users. Facebook is doing so by giving itself the exclusive right to choose the location of the court in case of a conflict and to demand phone numbers from a user's address book even if they are not the numbers of WhatsApp users.
