Utah Digital Choice Act (HB 418) including interoperability requirement was signed by Governor

On 27 March 2025, the Utah Digital Choice Act (HB 418) was signed by the Governor. The Bill establishes requirements for data portability and interoperability related to social media services. In particular, the Bill defines the rights of individuals to access, transfer and control their personal information, including their social graph. The Bill also stipulates that social media companies must implement interoperability interfaces using open protocols to enable the sharing of personal information across designated platforms with the consent of the user. The Division of Consumer Protection is to be granted rulemaking and enforcement authority, including the power to impose administrative fines and pursue civil penalties. The Act is scheduled to take effect on 1 July 2026.
