On 14 March 2024, the Texas Responsible Artificial Intelligence Governance Act was reintroduced to the State House as HB 149, superseding the HB 1709 Bill of the same name introduced on 23 December 2024. The revised Bill no longer imposes a comprehensive set of design requirements for high-risk AI systems used in the private sector. Instead, HB 149 focuses on prohibiting specific harmful use cases by any AI system, particularly those developed or deployed by state agencies. This includes AI systems intentionally designed to incite self-harm or violence, manipulate decision-making through deceptive trade practices, or engage in political viewpoint discrimination or unlawful biometric surveillance. The Bill mandates that government AI deployments avoid the use of “dark patterns” and ensure disclosures are made in plain language.
