Bundeskartellamt issues decision on Google as a company of paramount significance across markets

On 30 December 2021, the Bundeskartellamt determined that Google is a company of paramount significance across markets. Under section 19a of the German Competition Act (GWB), the Bundeskartellamt can open investigations against companies "of paramount significance for competition across markets" more quickly and restrain companies from implementing anti-competitive behaviour through a two-step procedure. In its decision, the Bundeskartellamt noted that Google holds a position of power across different markets and provides many highly sought-after services, thereby justifying its classification as a company of paramount significance. This determination may affect further Bundeskartellamt investigations into Google, including two ongoing investigations into its data processing terms and the Google News Showcase service. On the date on which the determination becomes final (due to e.g. conclusion or refusal of appeal), it will be valid for five years.
