On 20 February 2025, the Bill on Automated Decision Systems (AB 1018) was introduced to the California State Assembly, proposing a regulatory framework for automated decision systems (ADS) based on machine learning and artificial intelligence (AI). The Bill regulates the development and deployment of high-risk ADS within California making consequential decisions, such as those affecting employment, education, housing, and healthcare, would mandate developers and deployers to adhere to specific guidelines, including performance evaluations and independent audits, to ensure accountability and transparency while protecting individual rights. Starting 1 January 2027, deployers would need to disclose the use of ADS to subjects of consequential decisions, offer opt-out options, and allow appeals. Both developers and deployers would be required to submit their systems to third-party audits and maintain documentation. The Bill would also mandate that deployers using ADS for decisions affecting over 6'000 people must undergo impact assessments every three years.
