On 18 February 2025, Twitter International (X) announced on their platform they would be challenging the decision issued by the Berlin Regional Court II a case between Democracy Reporting International (DRI) and the platform. The Court had ruled that X must grant DRI immediate and unrestricted access to all publicly available data on platform X, including real-time data, via its online interface until 25 February 2025. The ruling also specified that X would bear the costs of the proceedings, and the case value was set at EUR 6'000. X challenged this decision on the grounds it undermined their right to due process in the German Constitution and that it allegedly threatened the privacy rights and free speech of the platform's users. In addition, X noted that the judge who ruled on the case from the Berlin Regional Court was a former employee of Gesellschaft für Freiheitsrechte, the civil society organisation that brought the case to the court and represented the applicant.
