On 18 December 2024, the Privacy Commissioner opened a consultation, due to close on 14 March 2025, on a draft Biometric Processing Privacy Code issued under the Privacy Act 2020. The code would strengthen current notification and transparency obligations in the Act, add a requirement to do a proportionality test on the impacts of biometric processing on individuals and mandate privacy safeguards. Furthermore, the draft code establishes limits on certain uses of biometric data, for instance, emotion analysis. The code is expected to come into force in 2025.
