Passed Bill No. 2338 of 2023 regulating the use of Artificial Intelligence including consumer protection regulation

On 10 December 2024, Bill No. 2338 of 2023 regulating the use of Artificial Intelligence, including consumer protection regulation, was passed by the Senate of Brazil. In particular, the Bill establishes the right of consumers to be informed if they interact with an Artificial Intelligence (AI) system, to receive information about the decision process, and to request human oversight of AI system decisions. Furthermore, the Bill enables individuals to contest and request the review of AI systems' decisions, recommendations, or predictions if the system has significantly impacted their interests. Finally, the Bill establishes the right of individuals to be free from discrimination based on personal data, including geographic origin, race, colour or ethnicity, gender, socio-economic class, sexual orientation, age, disability, religion or political opinion.
