On 29 July 2021, Bill Int 1760-2019, on tenant data privacy, has been partially implemented. The bill requires the owner of buildings utilizing a smart access system (e.g. fob system, biometric identifier) to obtain the consent of tenants for the use of information collected through such access systems. Further, the bill limits the extent to which data can be collected through such services and require tenants to delete the information within a certain period after a tenant has vacated a building. It also makes the sale of such data unlawful, creating a private right of action for alleged violations, although this private right of action will not be enforceable until 1 January 2023 to allow affected owners of smart systems to make the necessary replacements or upgrades to comply with the law.
