Brazil: Issued National Data Protection Authority sanctions against TikTok over irregular processing of personal data of children and adolescents

Description

Issued National Data Protection Authority sanctions against TikTok over irregular processing of personal data of children and adolescents

On 4 November 2024, the Brazilian National Data Protection Authority (ANPD) initiated a sanctioning process and issued compliance orders to TikTok over the alleged irregular processing of children and adolescents' personal data. The ANPD's technical review found inadequate age verification mechanisms and improper data processing practices, which potentially violate Article 14 of Brazil's General Data Protection Law (LGPD). The sanctioning process will further assess TikTok's data processing practices, including the collection of data from children and adolescents without age verification or platform registration and the use of the data for content personalisation in the unregistered feed. Further sanctions may be applied following this review.
