Introduced NO FAKES Act (S.4875)

On 31 July 2024, Senators Coons, Blackburn, Klobuchar, and Tillis introduced S.4875, “Nurture Originals, Foster Art, and Keep Entertainment Safe Act of 2024” (NO FAKES Act) into the Congress. The Act establishes the right of individuals to authorise the use of voice or visual likeness in a digital replica. The Act aims to protect the voice and visual likenesses of individuals from unauthorised computer-generated recreations from generative artificial intelligence (AI) and other technologies by preventing the production or distribution of AI-generated replicas without consent. The legislation would hold individuals or companies liable if they produce an unauthorised digital replica of an individual in a performance. Further, platforms would be liable for hosting an unauthorised digital replica.
